(Wilmington, DE) – William M. Remington, Director of Revenue announced today that the Grand Jury for the Superior Court in New Castle County returned an indictment against John T. Montgomery, 44, a truck-driver residing in Newark, Del.
Montgomery was charged with a total of 4 felony counts, including two counts of filing a false tax return, one count of attempted theft, and one count of theft.
The indictment pertains to tax years 2000 and 2001 where false returns were prepared and electronically sent to the Delaware Division of Revenue claiming fraudulent tax refunds.
In regards to the year 2000 tax return, Montgomery knowingly filed a false tax return using a false social security number and submitted a fraudulent W-2 form which falsely overstated taxable income and tax withheld in an attempt to obtain a fraudulent income tax refund in the amount of $2,136.00.
Additionally, Montgomery knowingly filed a 2001 tax return reflecting false wages and inflated withholding amounts and subsequently received a fraudulent refund in the amount of $1,752.00.
The charges against Montgomery stem from an investigation conducted by the Delaware Division of Revenue’s Criminal Investigation Unit and referred to the Delaware Attorney General’s office for indictment and prosecution.
Montgomery awaits arraignment and trial date in Superior Court in Wilmington.
