Wilmington, DE - Hockessin-based real estate agents Lewis Paul Nemeth, 61, and his wife, Mary E. Nemeth, 60, were charged this afternoon with three misdemeanor counts of willfully failing to file State of Delaware personal income tax returns, concealing more than $570,000 of income over the past three years, says Patrick T. Carter, Director of the Delaware Division of Revenue.
The Grand Jury for the Superior Court in New Castle County returned the indictment, alleging the couple intentionally failed to file Delaware personal income tax returns and to report more than $570,000 in gross earnings the couple received from 2000 to 2002 while operating as licensed real estate agents. The majority of the couple’s income was acquired in commission from residential real estate sales throughout New Castle County.
Delaware’s Division of Revenue calculates the state’s tax loss at more than $22,000.
The Nemeth’s three misdemeanor tax offenses are each punishable by a maximum one-year imprisonment and $2,300 in fines. The couple is currently awaiting arraignment and a trial date in the Superior Court of Wilmington.
Charges against the Nemeths stem from a six-month inquiry conducted by the Delaware Division of Revenue’s Criminal Investigation Unit – a branch of the Division dedicated solely to apprehending criminal tax offenders in Delaware. The investigation included scrutinizing Revenue records, as well as interviewing third parties and financial institutions. Findings were then referred to the Delaware Attorney General’s Office for indictment and prosecution.
